How the Divorce Mediation Process Works

STEP 01

Initial Consultation

The mediation process begins with an initial meeting where both parties are informed about the process, its objectives, and whether mediation is suitable for their circumstances. The mediator explains their neutral role and the expectations for both parties.

STEP 02

Identifying the Issues

Both spouses identify the matters that need to be resolved, such as child custody, parenting arrangements, division of matrimonial assets, spousal maintenance, and any other financial issues.

STEP 03

Mediation Sessions

The parties meet with the mediator to discuss each issue in a structured and confidential setting. The mediator facilitates constructive discussions, encourages cooperation, and helps both parties explore practical solutions without taking sides or making decisions for them.

STEP 04

Reaching an Agreement

Where common ground is reached, the agreed terms are recorded in a settlement agreement. Both parties have the opportunity to review the proposed terms and seek independent legal advice before proceeding.

STEP 05

Formalising the Settlement

Once both parties are satisfied with the agreement, the settlement can be incorporated into the divorce proceedings and submitted to the court for approval, where required. Once approved, it becomes legally binding.
